Believe it or not, but smartphones have made our lives simpler then ever. Today we can find anything and everything with a few taps on the screen of our smartphone and the world of information remains at our disposal all the time. But, these smartphones only have made us vulnerable as well. Today, any one can track our location, activities, plans, etc. just with a few taps on their smartphone screen, all they need to know is a little bit of technology.

The GPS technology used in smartphone that actually makes it smart can be worked against us as well. You might not even find out if someone somewhere is tracking your every single step and keeping a keen eye on your every move just with your smartphone.

Yes, your smartphone allows you to send emails, use online banking, conduct transactions over the internet, find things, check social media and a whole lot of things, but the same phone makes you open to spying by others. These smartphones use same wireless networks like your traditional phones but they are blessed with the intelligence of GPS (Global Positioning System) that detects your real time location using geotracking.

This geotracking features allows hackers, hackers or anyone who can use phone tracking apps to detect your location, browsing history, etc. with some simple tricks. Though, tracking someone’s cell phone is illegal but there also exceptions to it. However, if you are doing it without the other person’s knowledge here are the legal risks involved that might let you in a legal soup.

Computer Fraud And Abuse Act

Several countries and regions have framed specialized computer fraud and abuse acts, which most of them have extended to smartphone privacy as well. These acts allow legal action against the person obtaining information and data from someone else’s device using tracking technology. Any person’s computer, smartphone and other devices have been deemed as worthy of protection. Thus any kind of data infiltration and infringement of personal space will be considered illegal.

Electronic Communications Privacy

Most of the countries are still debating on whether they should extend electronic communications privacy act to smartphones as well or not. Though, going by the existing circumstances when tech savvy people are making wrong use of technology to spy on people for no good reason. Though, in some cases cell phone tracking is being done by governmental agencies as well, but that comes under exception by law.

Most of the people will agree to the fact that tracking someone’s smartphone without their knowledge should be deemed as illegal as well as unethical. The person in question in such cases is allowed to file a legal complaint against the tracker and in case found guilty any negative evidence against the person in question will not be enough to save the hacker from legal action. This means, you must have some really serious ground if you want to save yourself from risks involved in tracking a smartphone.
